Divorce
Divorce, also known as dissolution of marriage, is the termination of a marriage or marital union. In Florida, divorce requires the sanction of the court in a legal process because the issues may involve alimony, child custody, child support, distribution of property, etc. Florida does not recognize common law marriage.
Divorce should not be confused with annulment, which declares the marriage null and void with legal separation.
Reasons for divorce vary from adultery and abuse to personality clashes. Florida is a no-fault divorce state and unfortunately only one spouse is required to seek a divorce for the process to begin.
Family Law
Family Law is an area of law that deals with family and domestic relations matters including but not limited to marriage, adoption, surrogacy, child abuse, divorce, annulment, alimony, child support, child custody, paternity, etc.
This list is not exhaustive and varies depending on the jurisdiction. In Florida, many family law divisions see the most overcrowded dockets. This is in part due to litigants attempting to represent themselves rather than hiring an attorney.
